1. Introduction
Welcome to Octoped Tutor's Early Years Explorer. These Terms and Conditions outline the rules and regulations for the use of our mobile application. By accessing this application, we assume you accept these terms and conditions in full. Do not continue to use Octoped Tutor's Early Years Explorer if you do not accept all of the terms and conditions stated on this page.

2. Age Restrictions
The Early Years Explorer consists of two applications. There are no age restrictions for using the parents and children's application. All content provided by Octoped Tutor will be age appropriate and care is taken when choosing these materials, videos, stories, and games. The Teachers, managers, teaching assistant, and headmaster application will be accessed at the discretion of the administration (headmaster, headmistress, and managers).

3. User Conduct
Users of Octoped Tutor's Early Years Explorer are expected to behave in a respectful and considerate manner. Any form of harassment, bullying, or inappropriate behavior will not be tolerated and may result in the suspension or termination of the user's account. Users are also prohibited from using the application for any illegal activities or to violate any applicable laws and regulations.

 

4. License
Unless otherwise stated, Octoped Tutor owns the intellectual property rights for all material on Early Years Explorer. All intellectual property rights are reserved. Users may view and/or print pages from the application for their own personal use subject to restrictions set in these terms and conditions.

 

5. User Content
In these Terms and Conditions, "User Content" shall mean any audio, video, text, images, or other material you choose to display on this application. By displaying User Content, you retain all ownership rights to your content. However, you grant Octoped Tutor a limited, non-exclusive, worldwide, irrevocable, royalty-free license to use, reproduce, adapt, publish, translate and distribute it within the confines of the Early Years Explorer platform for the purpose of providing the services.

Octoped Tutor does not claim ownership over any photos and videos of children uploaded by users. Users are responsible for obtaining any necessary permissions or consents from individuals appearing in the uploaded photos and videos. Octoped Tutor will not use the user-uploaded content for any other purpose without explicit permission from the user. Furthermore, Octoped Tutor will not share or sell user-uploaded content to third parties without the user's consent.

Please note that Octoped Tutor is not responsible for any misuse or unauthorized access to user-uploaded content by other users or third parties. We encourage users to exercise caution and discretion when sharing photos and videos of children on the platform.

6. Data Protection and Privacy
Octoped Tutor is committed to protecting the privacy and security of our users' data. We implement robust security measures, including data encryption, user authentication, and regular security audits. 7. Parental Controls
Parents have the ability to manage and control the access and permissions of their child's account. This includes granting or revoking permissions, setting usage restrictions, and managing communication settings. We do not recommend the overuse of mobile applications by children and expect the parents to use good judgment in this area.

8. Disclaimers and Warranties
Octoped Tutor provides the Early Years Explorer application on an "as is" and "as available" basis. We do not guarantee that the application will always be available, or that it will be free from bugs or errors. We reserve the right to modify or discontinue the application at any time without notice.

 

9. Account Termination
Octoped Tutor reserves the right to suspend or terminate your account if you violate any of the terms and conditions stated on this page. We also reserve the right to suspend or terminate your account for any reason, with or without notice.

 

10. Disputes and Complaints
Users can lodge formal complaints in writing by sending an email to info@octopedtutor.com. We aim to respond to any and all complaints as soon as possible and will address issues at our own discretion.

 

11. Use in Educational Settings
Educators are welcome to use the Early Years Explorer application in their classrooms. However, they must ensure that they have obtained all necessary permissions and consents from parents or guardians before allowing children to use the application.

 

12. Subscription, Payment, and Refund Policies
Octoped Tutor offers various subscription plans for the Early Years Explorer application. Payments are non-refundable, and subscriptions can be cancelled at any time.

 

13. AI-Powered Features
The Early Years Explorer application uses AI-powered features to enhance the user experience. By using these features, you agree to the use of AI and acknowledge that the results provided by AI are not always 100% accurate or reliable.

 

14. Limitation of Liability
In no event shall Octoped Tutor, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this application, whether such liability is under contract, tort, or otherwise, and Octoped Tutor, including its officers, directors, and employees, shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this application.

 

15. Indemnification
You hereby indemnify to the fullest extent Octoped Tutor from and against any and all liabilities, costs, demands, causes of action, damages, and expenses (including reasonable attorney’s fees) arising out of or in any way related to your breach of any of the provisions of these Terms.

 

16. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

 

17. Changes to These Terms
Octoped Tutor reserves the right to revise these Terms at any time as it sees fit, and by using this application, you are expected to review such Terms on a regular basis to ensure you understand all terms and conditions governing the use of this application.

 

18. Governing Law & Jurisdiction
These Terms will be governed by and construed in accordance with the laws of Singapore, and you submit to the non-exclusive jurisdiction of the state and federal courts located in Singapore for the resolution of any disputes.
